Eardoc  Survey Official rules

HERE’S HOW TO ENTER: Beginning 12:00:01 AM ET on 10/1/2008, visit www.kencapltd.us or www.kencap.org  and follow the on-screen entry instructions. Entries must be received by 11:59:59 PM ET on 30/12/2009 to be eligible for the final daily drawing. Limit one entry per person. By entering, you certify that you are 13 years of age or older, parents may fill form for children. The complete form must be finished and a thank you page will indicate the participants in the random drawing.

2. ELIGIBILITY: the opportunity to win a camera is open to all global world residents who suffer from earache and their age are 2 to 18 and  use EARDOC.

To be excluded from the participations for the following reasons: myringotomy tubes in place within the last 6 months; perforation of the tympanic membrane; cerumen that projected into >50% of the radius of the ear canal; craniofacial deformities and/or middle ear abnormalities (e.g. cholesteatoma) ; any serious physical illness.

All federal, state and local laws and regulations apply. Void where prohibited by law.

3. RANDOM DRAWINGS: Drawings to award prize from among all eligible entries received per Rule #1 will be conducted by random generator in whose decisions are final on all matters relating to this offer. Drawings will be conducted at the end of the program. Odds of winning depend upon the number of eligible entries received, per Rule #1. Entry into one drawing does not constitute entry into subsequent drawings. No substitution or transfer of prize by winner permitted. Return of any prize/prize notification as undeliverable will result in disqualification and an alternate winner will be selected. Sponsor reserves the right to substitute prize of equal or greater value. Winners will be notified by mail. All federal, state international and local taxes are the sole responsibility of winner. By accepting prize, winner agrees to hold Sponsor, its respective directors, officers, employees and assigns, harmless against any and all claims and liability arising out of use of prize. Winners assume all liability for any injury or damage caused, or claimed to be caused, by participation in this promotion or use or redemption of any prize. Acceptance of prize constitutes permission to the Sponsor and its agencies to use winner's name and/or likeness for purposes of advertising and trade without further compensation, unless prohibited by law. All material submitted becomes the sole property of Sponsor and will not be returned.

4. PRIZES & APPROXIMATE RETAIL VALUES: prizes will be a Digital Flash Camera. (ARV: $500 and 50 EARDOCS will be send as second price for second election. or sending the DNA and 10 MB of digital data to outer space. only one kit of DNA separation and transfer
5. WINNERS: winners will receive mail to the address that they fill in the form.

6. General:  By entering this Survey, each participant  warrants that, (a) the participant  has read, understood, and followed the Official Eardoc survey official Rules; (b) agrees to be bound by the decisions of the Sponsor; and (c) the participant  is eligible under these Survey Rules.  All Potential Winners and their entries may be subject to verification and investigation before being awarded any prizes.  In the event not enough qualified entries are received, Sponsor is not responsible to award the prizes.  

By participating in this Survey, participant  agree that (a) any and all disputed, claims and causes of action arising out of or connected with this Survey, shall be resolved individually, without resort to any form of class action and Israel courts shall have exclusive jurisdiction over any dispute or litigation arising from or relating to this Survey

7. PUBLICITY, USE OF PARTICIPATIONS INFORMATION.  By filling the survey  the participant
(a)  Consents to the use by sponsors and their advertising and promotional agencies of his or her name, address, voice, statements and photograph, other likeness and information provided by the participant  for advertising and promotional purposes and
(b)  Grants the sponsor  the right to publish his or her proper name, city, province/state, country online and in print, or any other media, in connection with the Survey, the whole without further compensation, subject to applicable law.

The Sponsor reserves the right to use any and all information related to the survey, including information on entrants obtained through the Survey, for The sponsor and their advertising and promotional agencies purposes or any other purpose, subject to applicable law.

NOTICE TO ONLINE ENTRANTS: Sponsor not responsible for late, lost, damaged, incomplete, illegible, postage due or misdirected mail, or for faulty, incorrect or mistranscribed phone/e-mail transmissions, incorrect announcements of any kind, technical hardware or software failures of any kind including any injury or damage to any person's computer related to or resulting from participating in or experiencing any materials in connection with the promotion, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmission that may limit a user’s ability to participate in the promotion. CAUTION: ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor reserves the right to cancel or modify the online entry if fraud, misconduct or technical failures destroy the integrity of the program; or if a computer virus, bug, or other technical problem corrupts the administration, security, or proper administration of the program as determined by Sponsor/judging agency/administrator, in their sole discretion. In the event of termination of the online entry portion of the program, a notice will be posted online and the drawing(s) will be conducted from among all eligible online entries received prior to termination. In the event a dispute arises regarding specific individual entitled to receive prize , entry made by Internet will be declared made by the “authorized e-mail account holder” and any damage made to the Web Site will also be the responsibility of the authorized e-mail account holder of the e-mail address submitted at the time of entry. "Authorized e-mail account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g., business, educational institution etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Participant may be requested to provide Sponsor with proof that the participant is the authorized e-mail account holder of the e-mail address associated with the account/submission. Proof of sending will not be deemed to be proof of receipt by Sponsor. Any use of robotic, automatic, programmed or the like methods of participation will void all such submissions by such methods. Sponsor reserves the right to prohibit the participation of an individual if fraud or tampering is suspected or if the individual fails to comply with any requirement of participation as stated herein or with any provision in these Official Rules.
